One of the most common questions we are asked by our clients is how to go about expunging or clearing a criminal record. Our clients often report that their job hunting, custody litigation, careers and dating lives are being damaged by a minor conviction easily accessible online that they had when they were younger (and wilder). A new Pennsylvania law passed late last year is helping thousands of law-abiding citizens “erase” an isolated mistake in judgment from their earlier life.

Now you can expunge a conviction for a second degree misdemeanor (M2) such as retail theft, fraud, shoplifting, or bad checks or a third degree misdemeanor (M3) such as minor drug offenses, possession of paraphernalia, or petty theft from your public record. In order to qualify for this expungement, you must be conviction-free for the prior ten years. Unfortunately this new start does not apply to individuals who have been convicted of:

Simple Assault, Impersonating a Public Servant, Witness Intimidation or Retaliation, Interfering with the Investigation of Child Abuse, and a variety of Major Sexual Offenses.

The legal process of expungement is quite easy. For a fixed fee plus filing fees, we can meet with you, review your case, file the necessary documents, request expungement and represent you at the expungement hearing. If the District Attorney does not object, expungement is usually granted by the Court. The whole process takes approximately three months. Be aware that even though your record is no longer view-able by the public, law enforcement agencies can always access it.
